That means you’re free to link, distribute, copy, or any similar use of that material provided 1) it’s not used for any commercial purposes, 2) you provide a credit to me and a link back here, and 3) if you do decide to take and use anything I write, it has to be offered under these exact same terms.

If I find out you’re plagiarizing me, prepare for my wrath. If I find out you’re taking my written material and using it for commercial purposes – to make money – then we’ve got a problem. This includes derivative works, as noted under the license, so no 4th grade book reports (i.e., copying things in your own words).

On the other hand, I encourage you to spread, disseminate, and freely share anything you find here. Just give me credit while spreading the word, and we’re cool.

Fair Use of Copyrighted Material

From time to time I will make use of snippets from other published works, be it a blog, magazine, website, book, or what have you. In these instances, I direct you to the Fair Use provision under the US Copyright Act (Title 17 § 107):

“[T]he fair use of a copyrighted work, including such use by reproduction in copies or phonorecords or by any other means specified by that section, for purposes such as criticism, comment, news reporting, teaching (including multiple copies for classroom use), scholarship, or research, is not an infringement of copyright.”

One of this site’s expressly stated goals is commentary on and criticism of the fitness industry, experts and professionals in the fitness industry, and any products and services that may be associated with those individuals. A secondary goal, also expressly stated, is reporting on current events (aka news reporting).

That said, I make it a point to reference and credit any material I cite in as much detail as I can, so this shouldn’t be an issue. However, considering how, shall we say ‘confrontational’, the tone of this site can be at times, I feel the need to make this explicit policy.

Communications and Privacy Matters

Subscribers to my RSS feed and those choosing to post comments for discussion are guaranteed privacy. I won’t make those email addresses available under any circumstances.

I’m not in the habit of censoring comments for disagreeing with me, for the use of ‘objectionable’ language, or anything else along those lines. I will moderate comments at my discretion to control spam and in the event any serious legal issues come up, but barring that it’s free-speech central.

Regarding personal/private correspondence. Any messages you send to me, whether by email, IM, site comment, or any other medium, become my personal property, and I reserve the right to use that correspondence as I see fit.

As a general rule I consider personal communications to be private; however, considering some prior incidents I do have to make an exception to that policy. In particular, this means that if you send me hate mail, you’ve implicitly waived your right to privacy and given consent for me to post your message all over this site and anywhere else I see fit.

Don’t think I won’t do it, either. Privacy is one thing; if you write to me spewing a bunch of BS, you’ve waived that right.

Moral of the story: If you don’t want it to end up online, think twice about sending me hate-mail.

Spammers. I will not tolerate you, point blank, and I will take steps to report you to ISPs and any relevant law enforcement agencies. Comments are moderated on this site and I’ve got several spam-filtering tools that are very effective at catching your crap anyway; your spam comments will never be published. I’d highly suggest you do not eat up my bandwidth. You’ve been warned.
